The Annual IP Roundtable is designed for leaders in government, industry, academia, and the bar to frankly exchange ideas in a unique invite-only setting. This presentation will focus on two hot topics in copyright, fair use, and copyright protection for data. While there is a lot of discussion about what constitutes fair use, the exception is actually quite limited, especially outside of the educational context. We will walk you through all of the fair use factors and discuss when (and if) they might actually apply in common use cases. We will also spend some time talking about copyright protection for data, which is becoming increasingly important in today’s data driven world and has widespread implications on the use of data, many of which may be unknown to downstream entities using such data.
