“The Value of Life” regarding rules of evidence in wrongful death suits was published by the Illinois State Bar Association Illinois Bar Journal. Read an excerpt below.
“Wrongful death lawsuits in Illinois often involve federal and state law causes of actions. For example, plaintiffs seeking to recover for a violation of their constitutional rights may often file a federal civil rights action under 42 U.S.C. Section 1983 and include pendent state-law claims under the Illinois Wrongful Death Act and Survival Act. In such instances, courts often wrestle with difficult determinations at trial regarding what sort of evidence is admissible concerning a decedent’s life.”
