UIC Law Professor Sarah Dávila A. recently published an article discussing the legitimacy of using the Escazú Compliance Mechanism as an effective tool for advocacy. Read an excerpt below.

 

“This article seeks to pose important questions relating to the role that the Escazú Agreement has in Latin America and the Caribbean as the environmental treaty that protects important access rights (information, participation, and access to justice in environmental matters), as well as vulnerable individuals and groups such as human rights defenders. This article argues that the Escazú Agreement’s power as an important environmental treaty in the region largely rests on the ability of the Compliance Committee to monitor [treaty] compliance and provide for the effective adjudication of communications by persons or communities whose rights have been violated. It poses that the Compliance Committee’s legitimacy as a monitoring body rests on the possibility of accountability for persons and communities whose rights have been violated, but especially for human rights defenders engaging in important environmental work in the region.”
