“On August 11, 2023, without any fanfare, Illinois Governor J.B. Pritzker signed a bill into law that significantly altered the state’s civil liability landscape. For the first time, this new law allows the recovery of punitive damages in some cases under the Wrongful Death Act and the
Survival Act. However, the law is flawed as it shows a significant bias in favor of an important group of possible defendants while putting at a
disadvantage some victims who would benefit the most from the new policy. Therefore, while we should celebrate the adoption of the new policy, we must denounce its implementation and continue to advocate for change to ensure it becomes fully inclusive and fair.”
